CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 5 O.A./410/2026 (BANGALORE) [ TRANSFER ] Court No.: 2 No of Adjournment: Order Dated: 03/11/2026 N M DHANYA Vs GEOLOGICAL SURVEY OF INDIA
For Applicant(s) Advocate : Shri.B.S.Venkatesh Kumar For Respondent(s) Advocate : Order of The Tribunal
Shri B.S Venkatesh Kumar on behalf of the applicant. Heard on admission. Admitted. Issue notice to the respondents. Heard on issue of interim relief. The learned counsel for the applicant submits that the Transfer Order dated 29.10.2026 does not appear to be in public interest and four employees have been transferred out without giving any justification and without defining the public interest involved. It is very difficult to decide on interim relief without hearing the respondents. Even otherwise also, the Supreme Court vide judgement in S.C. Saxena Vs. Union of India and Ors, 2006 (9) SCC 583 states the following:- "...... 6....In the first place, a Government Servant cannot disobey a transfer order by not reporting at the place of posting and then go to Court to ventilate his grievances. It is his duty first to report for work, where he is transferred and make representation as to what may be his personal problems. This tendency of not reporting at the place of posting and indugling in litigation needs to be cured...." Hence, we are not inclined to give interim relief at this stage. The respondents are directed to file a short reply on the issue of interim relief and are also requested not to fill up the post against which the applicant was working, till the issue of interim relief is decided upon. List the case on 23.11.2026.
