CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 1 M.A./400/2026 (BANGALORE) [ EARLY HEARING ] In O.A./301/2026 TRANSFER Court No.: 1 No of Adjournment: Order Dated: 03/11/2026 D V KAVITHA Vs BSNL AND OTHERS

For Applicant(s) Advocate : Party in person For Respondent(s) Advocate : Shri S. Prakash Shetty for Respondent No.1, Shri K. Gajendra Vasu for Respondent Nos. 2 - 5 Order of The Tribunal

MA 400/2026 (Early Hearing): We have heard party in person as well as counsel for the respondents on MA No. 400/2026 for early hearing. The applicant has filed MA No. 400/2026 for preponing the case from 17.11.2026 when the case was posted for filing reply on MA 360/2026 by the respondents. In the meanwhile, the applicant has further filed another MA No. 401/2026. The applicant submits that she would like to withdraw MA No. 360/2026 and MA No. 401/2026 which are having similar contents. Further, on submission it is found that it is not unconditional withdrawal of these MAs and she submits that she will file revised memo for withdrawal. Hence, it appears that she is not interested to withdraw both the MAs and she would like that certain aspects, which are mentioned in those MAs to be heard. Hence, we do not find any change in situation which was there earlier. Hence, MA No. 400/2026 for early hearing does not satisfy the criteria of overturning the two weeks’ time given to the respondents for filing reply to the MA 360/2026.

Considering the same, MA No. 400/2026 for early hearing is hereby dismissed. Respondents may file their replies to MA No. 360/2026 as well as MA No. 401/2026 by 17.11.2026.
