CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 18 O.A./1117/2026 (SRINAGAR) [ RECOVERY FROM PENSION ] [ SENIOR CITIZEN ] Court No.: 2 No of Adjournment: 2 Order Dated: 30/10/2026 BASHIR AHMAD SOFI Vs UNIVERSITY OF KASHMIR
For Applicant(s) Advocate : INAIN TASADUQ JAN
For Respondent(s) Advocate : ASIF MAQBOOL Order of The Tribunal 01/ A detailed order was passed in this matter on 08-10- 2026, wherein, in viw of the peculiar facts and circumstances of the case, personal presence of Assistant Registrar, University of Kashmir, Srinagar, was sought for before the court. 02/ Matter came up for consideration today, the Assistant Registrar, General Administration, University of Kashmir - Shri Meraj ud din Bhat, is present before the court. Learned counsel for the respondents prayed for a shortest possible time to allow the respondents to review the impugned order as, prima facie, it appears that it is non speaking, cryptic and has been issued without application of mind.
03/ In the aforementioned backdrop, in the interest of justice, let two weeks' time be availed by the respondents, particularly, the Assistant Registrar, University of Kashmir - Shri Meraj ud din Bhat, to come up with instructions and also to explore the possiblity of redressal of the grievance. 04/ List for considration on 18-11-2026. However, Shri Meraj ud din Bhat, Assistant Registrar, General Administration, University of Kashmir, Srinagar, to remain present before the court on next date of hearing along with all the record pertaining to the case, of course, after maintaining its secrecy and security. In the meanwhile, subject to objections and till next date of hearing and subject to orders to be passed by the University of Kashmir, after review of the impugned order, no recovery shall be effected from the petitioner. To this effect, I am fortified by a catenae of judgements delivered by the apex court in cases titled as State of Punjab versus Rafiq Masih (white washer case) and Thomas Daniel versus State of Kerala, (AIR 2022 SC 2153).
