1. The matter came up for consideration on 21.09.2026. The proceedings could not proceed further for the reasons that the respondents/contemnors had preferred a writ petition before the Hon'ble High Court of Jammu & Kashmir and Ladakh at Srinagar bearing WP No.1898/2026 in which vide an earlier order, the contempt proceedings before this Court were stayed.

2. What was challenged by the respondents/contemnors in the aforesaid writ petition was the order passed by this Tribunal on 04.08.2026, in which non bailable warrants of arrest were ordered against the contemnors.

3. Again, the matter came up for consideration today. Learned counsel for the parties have produced an order of the Division Bench of the Hon'ble High Court of Jammu & Kashmir and Ladakh in the aforesaid writ petition, wherein the writ petition has finally been decided.

1. "Thus, the appeal is disposed of by quashing the impugned order and directing the parties to cooperate with the ongoing proceedings of the OA, to be decided finally by the learned CAT within a period of three months from today. The right of the candidate to the post of Librarian at the Islamic University shall remain protected, subject to the outcome of the OA."

4. Perusal of the judgment of the Hon'ble Division Bench of the High Court of Jammu & Kashmir in the aforesaid writ petition shows that this Tribunal has been asked to decide the matter within three months finally and the order dated 04.08.2026 passed by the Tribunal has been quashed. The parties have been directed to cooperate with the ongoing proceedings in the OA.

5. Mr. Faizan Majid Bhat, learned counsel representing the petitioner submits that none of the earlier orders passed by this Tribunal have either been quashed or stayed. What has been quashed is only the order for issuance of non bailable warrants. Thereby he submits that the continuous non compliance of the basic order, which was also assailed before the Hon'ble High Court and upheld, is yet again held in breach. He submits that respondents/contemnors, in law, have to purge out of the contempt first and then they have a right to be heard, as the Hon'ble HIgh Court in three petitions has neither set aside nor quashed the basic order passed by this Tribunal on 02.06.2026. He submits that even otherwise the right of the petitioner has been protected by this Tribunal as well as by the Hon'ble Division Bench of the High Court.

6. Since Mr. Syed Musaib, learned DAG representing the University/contemnors, submits that let the OA be decided finally, however, Mr. Faizan Majid Bhat, while vehemently rebutting these arguments, submits that the respondents/contemnors have to first purge out of the contempt, which they have not, as stated above.

7. List this matter on 30.11.2026 as case No.1 (under order of Hon'ble High Court). Prasant Kumar Member (A) M. S. Latif Member (J) Shailesh Kumar ( ps )
