CENTRAL ADMINISTRATIVE TRIBUNAL ERNAKULAM Order Sheet Item no.: 19 O.A./872/2015 (ERNAKULAM) [ ABSORPTION ] Court No.: 1 No of Adjournment: 51 Order Dated: 02/11/2026 BINDU K Vs EMPLOYEES STATE INSURANCE CORPORATION For Applicant(s) Advocate : Mr. Chekkutty Thazhathedath For Respondent(s) Advocate : Mr. T.C. Govindaswamy, Mr. T.V. Ajayakumar Notes of The Registry Order of The Tribunal MA/430/206 (for condonation of delay), MA/431/2026 (setting aside abatement) & MA/432/2026 (for impleading) These applications are filed by the legal heirs of the deceased 4th applicant to get themselves impleaded consequent to the death of 4th applicant, to set aside abatement and also for condoning the delay in filing the application. The 4th applicant died on 08.08.2022 which is evidenced by Annexure A-19 death certificate. It seems that the death occured while the matter was pending before the Hon'ble High Court. RP No. 1069/2026 has been filed to review the judgment and to get the legal heirs impleaded. However, by judgment dated 26.09.2026, a copy of which was produced before us and held that there is no reason to review the judgment since the legal heirs can come on record at any time since the Court has restored the OA. Having heard both sides, we are inclined to allow the MA thereby condoning the delay and setting aside abatement and also consequently allowing the impleadment application filed by the husband and daughter of the 4th applicant to come on record as additional applicant Nos. 12 and 13 respectively. Accordingly, all the MAs are allowed. Carry out impleadment. Heard both sides. Reserved for orders. V RAMA MATHEW MEMBER (A) JUSTICE SUNIL THOMAS MEMBER (J) A X ( steno 'c' )
