ORDER

The applicant was discharged on completion of terms of engagement on 31.03.2021. He was in a Permanent Low Medical Category on account of disability of ‘Bicondylar Fracture Tibia (RT) (OPTD)’, the extent of which was assessed to be 30% for life but neither attributable to nor aggravated by military service. Perusal of the Release Medical Board (RMB) shows that the date of origin of the disability was 08.06.2012 and the location was Dehradun. Based on the evidence on record, the RMB assessed the disability to be neither attributable to nor aggravated by military service as the fracture was result of an accident while the applicant was on leave. Court of Inquiry on record as Annexure A-2 supports the finding.

Learned counsel for the applicant has argued that the accident took place when the applicant was proceeding from the Railway Station to his village. Thus, the cause of the disability had to be assessed to be attributable to military service.

In light of the evidence on record, we are unable to accept the submission.
