ORDER

The applicant was discharged on 31.03.2025 on fulfilment of terms of engagement. He was in a Permanent Low Medical Category on account of disability of ‘Other Specified Intervertebral Disc Degeneration’, the extent of which was assessed to be 6.888% for life and attributable to military service. Claim for grant of disability element was rejected because the extent of disability was less than 20%.

Learned counsel for the applicant has relied upon Categorization Medical Board dated 04.04.2019 (Annexure A-4) to submit that the said Board had assessed the extent to be 20%. The Release Medical Board was not justified in returning a different finding without considering the earlier finding.

Notice.

Mr. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply.

Adjourned to 16.04.2027.
