ORDER
The applicant was discharged on completion of tenure on 31.01.2024. He was in a permanent low medical category on account of disability of ‘Coronary Artery Disease’, the extent of which was assessed to be 30% for life but neither attributable to nor aggravated by military service. Assessment of neither attributable to nor aggravated by military service was made because the applicant suffered a ‘Heart Attack ‘ while on leave. Against the rejection of the claim, the applicant preferred a first appeal. Learned counsel for the applicant has relied upon observations made by the First Appellate Committee that the applicant was posted in a high altitude area since January 2020 and that disability should have been assessed attributable to military service. However, claim was rejected by the PIFA and thus the first appellate committee could not interfere.
Learned counsel for t the applicant has relied upon order dated 07.05.2026 passed by Regional Bench Chandigarh in OA 455 of 2025 Ex. Major Shresth Joshi (Retd) Versus Union of India and Others to submit
OA 983 of 2026
that the PIFA had no locus or jurisdiction to interfere with the recommendation made by the competent authority. Notice. Mr. Jagjot Singh Lalli, Dy. Solicitor General of India accepts notice on behalf of the respondents and waives service and seeks time to file reply. Adjourned to 16.04.2027.
