ORDER
The applicant was discharged on 30.06.2008 on fulfilment of terms of enrolment. He was in a Permanent Low Medical Category on account of disability of ‘Ischaemic CVA RT MCA with LT Hemiperaesis’, the extent of which was assessed to be 15-19% for two years and attributable to military service. Claim for grant of disability element was, however, rejected because the extent of disability was less than 20%. Aggrieved with the denial of disability element, the applicant preferred OA No.1836 of 2021, which was disposed of vide order dated 28.02.2024 with a direction to the respondents to conduct a Re-Assessment Medical Board (RAMB) within four months. Accordingly, RAMB was conducted on 29.06.2024. It assessed the extent of disability to be 70% for life. Based on the finding, a demand notice dated 03.07.2025 was issued on behalf of the applicant. The same was followed by a reminder notice dated 19.01.2026. Second reminder dated 12.05.2026 was sent but no response has been received till date.
OA 988 of 2026
-2-
Learned counsel for the applicant has submitted that the applicant is entitled to benefit of disability element @ 70% rounded off to 75% with effect from the date of conduct of RAMB. Denial of the same is illegal. Notice.
Mr. JS Lalli, DSGI, accepts notice on behalf of the respondents and waives service and seeks time to file reply.
Adjourned to 16.04.2027.
