ORDER
The applicant was invalided from service on 18.10.1977. Total service rendered by him was 06 years, 03 months and 17 days. The invalidment was the result of disability of ‘Epileptic Fits’, the extent of which was assessed to be 30% for two years but neither attributable to nor aggravated by military service. Despite the disability being neither attributable to nor aggravated by military service, a claim for grant of disability element was preferred by the Records Office. The Chief Controller of Defence Accounts(P) accepted the claim by treating the disability to be attributable to military service. The applicant has thus been in receipt of disability pension from 19.10.1977 till 28.11.1985.
For more than 35 years, the applicant did not pursue his claim. Somehow a Re-Assessment Medical Board (RAMB) was conducted on 31.05.2023 which assessed the extent of disability to be 20% for the intervening period and 10% for life. The applicant has thus demanded grant of disability pension for the intervening period but requisite benefit has not been released to the applicant. PCDA(P) Prayagraj has issued a letter dated 01.09.2025 raising certain objections.
OA 989 of 2026
Learned counsel for the applicant has submitted that in view of the finding of RAMB dated 31.05.2023, PCDA(P) Prayagraj could not have objected to the claim. Notice. Mr. Jagjot Singh Lalli, Dy. Solicitor General of India accepts notice on behalf of the respondents and waives service and seeks time to file reply. Adjourned to 16.04.2027.
