ORDER

The applicant is aggrieved because his claim for grant of disability element has been rejected.

While serving in the Defence Security Corps (DSC), the applicant was discharged at his own request on 30.11.2024. Total service rendered by him was 27 years, 03 months and 11 days. His medical category had been permanently downgraded on account of disability of ‘Cerebrovascular Accident – Right MCA Territory Stroke’, the extent of which was assessed to be 65.5% for life but neither attributable to nor aggravated by military service.

Learned counsel for the applicant has referred to Release Medical Board (RMB) to submit that the stroke was the result of infarction due to thrombosis. Thus, the same could not have been assessed to be neither attributable to nor aggravated by military service merely because onset was while he was on leave. Notice.

Mr. Mukesh Mehra, Sr. PC accepts notice on behalf of respondents and waives service and seeks time to file reply. Adjourned to 16.04.2027.
