CRP.No.7015 of 2026
2. It is not in dispute that the respondent herein filed a original petition in RLTOP.No.292 of 2024 for repossession against the petitioner and the same was allowed. Aggrieved by the order for repossession, the petitioner filed an appeal in R.L.T.A.No.87 of 2025 and the same is pending on the file of the XVIII Additional Judge, City Civil Court, Chennai. When the appeal came up for final disposal on 29.09.2026, the petitioner’s counsel was not ready to argue the matter and at his request, the matter was adjourned to 16.10.2026. Since the petitioner’s counsel was not ready to argue the matter, the Appellate Tribunal refused to extend the stay and listed the appeal for disposal on 16.10.2026.
3. A perusal of the e-court status filed before this Court dated 16.10.2026 would indicate that the petitioner’s counsel did not argue the matter on 16.10.2026 also. However, he filed a memo and based on the same, the matter was adjourned to 29.10.2026. On 29.10.2026, there was no representation for the appellant/petitioner herein. After recording the same, the Appellate Tribunal adjourned the matter to 30.10.2026. On 30.10.2026 again the learned counsel for the appellant/petitioner herein was not ready to argue the matter. He filed a memo stating that the appellant/petitioner herein filed a revision in C.R.P.SR.No.183258 of 2026 challenging the order passed by the Appellate Court, dated 29.09.2026.

4. It was also represented before the Appellate Tribunal that the appellant/petitioner herein filed Transfer Original Petition in Tr.O.P.SR.No.12936 of 2026. The Appellate Tribunal after recording that the petitioner neither furnished the Civil Revision Petition Number or Transfer Original Petition Number, observed that this Court in C.R.P.No.6248 of 2026, directed disposal of RLTA within a period of six weeks from the date of receipt of copy of the order and the said order was received by the Court on 16.10.2026 and adjourned the matter to 06.11.2026.
5. The sequence of events before the Appellate Tribunal would make it clear that continuously for nearly four hearings, the petitioner’s counsel was not ready to argue the matter inspite of the fact that the appeal was posted for final disposal. Therefore, it appears taking advantage of the interim stay, the appellant/petitioner herein failed to cooperate for disposal of the main appeal. Therefore, the Appellate Tribunal rightly refused to extend the interim stay granted and adjourned the matter with a direction to argue the appeal. I do not find any irregularity or illegality in the exercise of jurisdiction of the Appellate Tribunal. Accordingly, this Civil Revision Petition stands dismissed.
6. At this juncture, the learned counsel appearing for the petitioner submits that the petitioner is ready to argue the appeal before the Appellate Tribunal on the next date of hearing (i.e., on 06.11.2026). The said statement is

recorded. The Appellate Tribunal is directed to dispose of appeal on merits and in accordance with law.
7. In the light of the submission made by the learned counsel appearing for the petitioner that the petitioner’s counsel will argue the matter before the Appellate Court on 06.11.2026, the delivery order passed by the Executing Court is kept in abeyance till 13.11.2026. No costs. Consequently, the connected Miscellaneous Petition is closed. 04-11-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No dm Note: Issue order copy today (04.11.2026).
