COMMON ORDER

The petitioner in both the writ petitions alleged that they had pledged jewels as security with the Punjab National Bank/third respondent. When they went to redeem the jewels, they were informed that the jewels were missing from the custody of the bank. In place of the genuine jewels that had been pledged by the petitioners, the jewel packets contained fake/counterfeit jewels. Therefore, the petitioners lodged a complaint with the second respondent police on 23.08.2026. As no action has been initiated, they are before this Court.

2. When the matter was taken up, Mr.S.Yogaraja Sekar submitted that even before the complaint was lodged by the petitioners, the authorized representatives of the Punjab National Bank had lodged a complaint and that had been registered by Central Crime Branch, Team I in Crime No.119 of 2026. He states that as the transaction that the petitioners alleged falls within the same category, another FIR cannot be registered.

3. I have carefully considered the submissions on both sides. I have gone through the records.

4. Mr.S.Yogaraja Sekar is correct that when an FIR has already been registered, subsequent complaints on the same transaction can only be treated as a statement under Section 183 of BNSS. There shall be a direction to the investigating officer, who is investigating Crime No.119 of 2026, to record the statement of both the petitioners on 05.11.2026 at 03.00 p.m.

5. With the above direction, both the writ petitions are disposed of. 04-11-2026 KAL
