ORDER
This application has been filed seeking the issuance of a subpoena to Mr.Selvakumar, residing at Door No.F4, First Floor, Lotus Colony, Nandanam Extension, Chennai 600 035, to record his evidence in C.S.No.61 of 2023.

2. According to the applicant / defendant, Mr.Selvakumar is in occupation of a portion of the property as a tenant under the plaintiff. The purpose of issuing a subpoena to the tenant is to prove that the common area was let out to him by the respondent / plaintiff.
3. In the cross-examination, the plaintiff had categorically admitted that he had let out a portion of the vacant space marked as ‘2’. Therefore, no useful purpose will be served in issuing a subpoena to the tenant.
4. In view of the above submission, A.No.3008 of 2026 is closed.
