ORDER

(Order of the Court was made by M. NIRMAL KUMAR J.) This petition has been filed to grant 30 days interim release to the detenue M.Stella baby aged 54 years W/o.Madhan Maruthuvendan now detained at Special Prison for Women, Madurai, enabling her to conduct and participate her elder son's marriage.

2. The mother of the petitioner was arrested in the ground case on 07.10.2026 and thereafter she was detained by the second respondent pursuant to the detention order passed in Detention Order No.161/BBCDEFGISSSV/2026 dated 27.10.2026, branding her as a 'Goonda' as contemplated under Section 2(f) of the Tamil Nadu Act 14 of __________

( Uploaded on: 04/11/2026 04:30:27 pm )

CRL MP(MD) No. 23478 of 2026 1982. The detention order was served on the mother of the petitioner on 28.10.2026. Immediately the petitioner has sent a representation to the Additional Secretary to Government, Commissioner of Police, Superintendent of Prison to revoke the order of detention. In the meanwhile the marriage for the elder son of the detenu namely Aakash was fixed on 11.11.2026 at Moon Mahal, N.G.O.'A' Colony, Near Jeba Garden, Tirunelveli followed by a reception on 16.11.2026 at Aarya Convention, Shankarpathy Road, Janwada, Hyderabad and it is the first function in the family after 25 years. Further the father of the petitioner also underwent surgery in his leg and he is unable to move, thereby for making arrangement for the marriage the presence of the petitioner is very much required, hence the present petition has been filed seeking interim release.

3. The learned Additional Public Prosecutor submitted that the marriage scheduled to be held on 11.11.2026 is true, however seeking 30 days ordinary leave may not be proper and the petitioner may be permitted to attend the marriage with escort. He would further submit that the Inspector of Police, C-1Junction Police Station, Tirunelveli has filed a petition before the learned Judicial Magistrate No.IV seeking custody of the mother of the petitioner in Crime No.454 of 2026 and the __________

( Uploaded on: 04/11/2026 04:30:27 pm )

CRL MP(MD) No. 23478 of 2026 same is also pending. He would further submit that due to this order the custody would get delayed and the apprehension is that tampering of some documentary evidence in this case is possible.

4. The learned counsel appearing for the petitioner fairly submitted that all the documents have been seized by the police and he has no objection for custody. He further submitted that the engagement ceremony is fixed on 08.11.2026, marriage on 11.11.2026 and after marriage the detenue is ready to surrender and he has restricted his prayer for attending marriage alone and with regard to attending reception at Hyderabad he is not pressing the same.

5. Taking note of the fact this is the first marriage in the family of the detenue and the husband of the detenue recently underwent surgery and his movement is restricted, hence detenue attending marriage and her participation is very much required. Hence this Court is inclined to grant five days interim release to the mother of the petitioner with escort.

6. The Criminal Miscellaneous Petition stands disposed of with the following directions:

(i) The respondent is directed to grant 5 days leave to the __________
