ORDER

This civil revision petition has been filed under Section 115 of the Civil Procedure Code (CPC) against the order dated 06.3.2026 made in M.P.No.1 of 2026 in MCOP.No.4016 of 2010 on the file of Motor Accident Claims Tribunal, (Fifth Judge, Small Causes Court), Chennai (for short, the Court below) wherein the application filed by the petitioner under Section 5 of the Limitation Act to condone the delay of 2874 days in filing the application to restore the claim petition, came to be dismissed.

2. Heard the learned counsel for the petitioner.

3. This Court has carefully considered the submissions of the learned counsel for the petitioner and perused the materials available on record and more particularly the impugned order.

4. The petitioner, who is the claimant, filed the said claim petition seeking for payment of compensation for the injuries

sustained by him in an accident that took place on 16.8.2008. The said claim petition came to be dismissed for default on 21.11.2017. Later, the petitioner filed M.P.No.1 of 2026 before the Court below seeking to condone the delay of 2874 days in filing the application to restore the claim petition. However, it was dismissed by the impugned order. Aggrieved by that, the above revision has been filed before this Court.

5. In the considered view of this Court, the reasoning given by the Court below dismissing MP.No.1 of 2026 does not suffer from any perversity warranting the interference of this Court. In the case in hand, the Court below found that there was a delay of nearly 13 years since the claim petition was pending from the year 2012 for the petitioner’s side evidence and that the evidence was not taken for various reasons till 21.11.2017 for more than five years. Hence, there are absolutely no merits in this revision.

6. Accordingly, the above civil revision petition is dismissed. 03-11-2026
