Earlier on 27.10.2026, based on the request of the learned counsel for the appellant, for taking steps for the deceased sole appellant in this appeal, this matter has been adjourned today. Even today, the learned counsel for the appellant had once again sought time for taking steps for the deceased sole appellant in this appeal.

2. On perusal of the docket sheet, it reveals that the learned counsel for the appellant had sought several adjournments from the month of July 2026, for taking steps for the deceased sole appellant in this appeal, however no steps have been taken till date.

3. Considering the fact that the appeal is of the year 2016 and already, twice the matter was listed under the caption “for dismissal” and also the fact that no steps have been taken for the deceased sole appellant in this appeal, which shows that the legal representatives of the deceased appellants are not interested to proceed with this appeal, this Court is inclined to dismiss this second appeal for default.
