ORDER

The petitioner is seeking a writ of mandamus to direct the respondents 2 and 3 to admit the petitioner’s son into the 3rd respondent College, pursuant to the provisional allotment order issued by the 2nd respondent.

2. The complete details of the examination, etc., are not necessary for the adjudication of the present Writ Petition.

3. It is not in dispute that the petitioner’s son applied for and passed the NEET M.B.B.S. U.G. examination and was allotted a seat in the 3rd respondent college viz., PSP Medical College Hospital and Research Institute, Oragadam, Kanchipuram, under the Management Quota.

4. The grievance of the petitioner is that, pursuant to the receipt of the provisional allotment order, the petitioner’s son went to the College on 13.10.2026 and met the College Management. However, the admission process could not be completed on account of certain conditions imposed by the

College. Though certain reasons have been stated in the affidavit, it would not germane to reflect the said reasons in the present Writ Petition, for on going reasons.

5. It is not in dispute that a sum of Rs.15,00,000/- (Rupees fifteen lakhs only) was paid to the 2nd respondent, pursuant to which the allotment was made.

6. Allegations and counter-allegations were made during the course of hearing. However, without going into such allegations levelled against one another, this Court questioned the College as to whether any seat was vacant and available. The learned counsel appearing for the 3rd respondent would submit that one seat is available.

7. The students study hard and prepare for the NEET examination to secure a seat in one of the Medical Colleges. The petitioner’s son had also passed the examination and secured a seat. Though the reason stated by the 3rd respondent College for the petitioner’s son not being able to produce the certificates before the stipulated deadline is sought to be justified by the 3rd respondent College, the same cannot be accepted. The petitioner had, in fact, given a complaint with the 2nd respondent, who had enquired into the issue. In

the counter affidavit filed by the 2nd respondent, it is specifically stated that the enquiry conducted by the 2nd respondent revealed the presence of the petitioner’s son in the College on 15.10.2026, which was the last date for admission.

8. If this Court does not extend any indulgence in the facts and circumstances of the present case, it would only result in grave injustice to the student, namely, the petitioner’s son, and consequently, he would lose the seat allotted to him.

9. This Court is not creating any new seat for the purpose of the candidate. However, the existing vacancy available in the 3rd respondent College can very well be considered for admitting the petitioner’s son.

10. In the said circumstances, the petitioner’s son shall appear before the 3rd respondent College Authorities today itself and submit the requisite documents and also fulfil the other conditions, if any, required for securing admission into the 3rd respondent College.

11. Since the case was taken up after lunch and the arguments concluded at 03.45 p.m., it is not possible to make a physical copy of this order available. The learned counsel appearing for the 3rd respondent would submit that he would inform the 3rd respondent College Authorities about the petitioner’s son approaching the College and that the certificates would be received and the admission process would be completed. Needless to say, the learned Special Government Pleader appearing for the respondents 1 and 2 would also instruct the 2nd respondent regarding the order passed by this Court.

12. Accordingly, this Writ Petition stands allowed. No costs. 03.11.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vv2 To
