COMMON ORDER
These two Writ Petitions are filed on behalf of a limited liability partnership and an individual in relation to the request for permission to fell trees in Survey Nos.699, 700, 711/1A, 704/3 and 701, respectively.
2. Learned counsel for the petitioners submits that the request for permission was rejected solely on the ground that W.P.(MD) No.9575 of 2025 is pending. He points out that there is no interim order in said Writ Petition preventing consideration of the application.
3. As pointed out by learned counsel for the petitioners, the application was rejected by recording as under: “Court case pending (WP(MD) No. 9575 of 2025)”
4. W.P.(MD) No.9575 of 2025 is a Writ Petition filed by the second respondent in these Writ Petitions seeking to prevent the petitioners herein and M/s.Torrent Urja 14 Pvt. Ltd. from installing fencing and solar panels without obtaining the requisite permission. As on date, no interim order is in operation in said Writ Petition. Therefore,
WP(MD) Nos. 16816 & 16968 of 2025 the rejection of the applications merely on the ground of pendency of the Writ Petition is untenable. Consequently, the orders impugned in these Writ Petitions are set aside and these matters are remanded for reconsideration by the District Forest Officer. After providing a reasonable opportunity to the petitioners and the second respondent in these Writ Petitions, fresh orders shall be issued in accordance with law, uninfluenced by the pendency of W.P.(MD) No.9575 of 2025.
5. These Writ Petitions are disposed of on the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed. 03-11-2026 Index: No Speaking Neutral Citation: No JEN To The District Forest Officer,
