COMMON ORDER
The petitioners, on the strength of an assignment, that is benefited in their favour. have approached this Court for carrying out necessary corrections in the village records in relation to the subject properties.
2. Heard the learned Counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.
3. The learned Government Advocate appearing for the respondents relying upon a judgment of a Hon’ble Division Bench of this Court made in W.P.(MD)No.23748 of 2026, dated 20.08.2026 (R.Pakkiyaraj -vs.-0 The District Collector, Pudukottai and others) and submitted that in compliance with the directions issued, encroachment notices have been issued. Hence, they approached this Court with the aforesaid relief.

However, from the perusal of the records, it is to be noted that even though a positive direction had been issued by the Hon’ble Division Bench of this Court to remove the encroachment, an assignee of the land through a valid assignment which as of this date stands intact, cannot be termed to be an encroacher and in that regard, this Court finds no impediment in directing the respondents to consider the representations of the petitioners, all dated 24.08.2026 in carrying out necessary corrections in the revenue records.
5. In fine, the Writ Petitions stand disposed of with a direction to the third respondent to consider the representations of the petitioners, all dated 24.08.2026 and if they have a valid assignment deeds, necessary corrections, as sought for by them, can also be carried out in the revenue records.
