ORDER

The petitioner states that he is the owner of agricultural land comprised in Survey No.862/3A1 at Sathankulam Village, Tuticorin District. Alleging that respondents 7 and 8 purchased the agricultural land in Survey No.862/3B2 and that said respondents converted the fertile agricultural land into commercial housing plots on the basis of No __________

WP(MD) No. 31245 of 2026 Objection Certificate issued by the third respondent, the petitioner has approached this Court challenging said No Objection Certificate and subsequent communications.

2. Relying on an aerial photograph of the site, learned counsel for the petitioner submits that all the adjacent lands, including the petitioner’s land, are being used for agricultural purposes. It is submitted further that the pipelines for irrigation of the petitioner’s land run beneath the lands of respondents 7 and 8.

3. Accepting notice on behalf of respondents 1 to 6, Mr.A.Sivasubramanian, learned Additional Government Pleader, submits that the petitioner has submitted a false Adangal. Handing over a copy of the Adangal and relevant documents, he points out that both the petitioner’s land in Survey no.862/3A1 and the land of respondents 7 and 8 in Survey No.862/3B2 are classified as ‘Tharisu’ in the revenue records. He also points out that No Objection Certificate was issued by the third respondent after taking note of the nature of the land. __________

4. In the No Objection Certificate issued by the third respondent on 24.07.2026, it is recorded as under: "

மே ற்படி புன்செய் நிலத்தின்

ஆவணங்களின் அடிப்படை யில்

வே ளாண்மை இணை இயக்குநர்,

தூத்துக்குடி அவர்கள் 21.07.2026 அன்று

நே ரடியாககளஆய்வுசெய்ததில்மே ற்கண்ட

சர்வே புஞ்சை நிலமானதுகடந்தமுன்று

ஆண்டுகளாக தரிசாக இருப்பது கள

ஆய்வில்தெ ரியவருவதால்வே ளாண்மை

அல்லாத பயன்பாட்டிற்கு

தடை யில்லாச்சான்றுஇத்துடன்இணை த்து அனுப்பலாகிறது.

மே லும்மே ற்படிபஞ்சை

புல எண்ணில் தாழ்வழுத்த மின்பாதை

செல்கிறது என்ற விபரம் தெ ரிவிக்கப்படுகிறது.”

5. Thus, the third respondent noticed that the land is not being put to agricultural use for more than three years and that it is in the nature of waste land. The findings recorded therein are corroborated by the classification of the land in the Adangal extract handed over by the official respondents. The official respondents have also categorically denied that the pipelines for supply of water to the petitioner’s land are laid beneath the lands of respondents 7 and 8. In this regard, it is pertinent to notice that the petitioner’s land is also classified as ‘Tharisu’ in the Adangal. __________

6. Considering the above aspects, no case is made out to exercise discretionary jurisdiction in favour of the petitioner. Therefore, this Writ Petition stands dismissed.
