ORDER

This Civil Revision Petition has been filed under Article 227 of the Constitution of India challenging the fair and decreetal order dated 16.03.2026

CRP No. 6873 of 2026

passed in IA No.12 of 2026 in OS No. 138 of 2007 on the file of the Principal Sub Ordinate Court, Hosur, wherein the application filed by the petitioner/4th defendant under Order IX Rule 7 of C.P.C., to set aside the ex-parte order dated 07.11.2007, came to be dismissed by the Court below.

2. Heard the learned counsel for the petitioner and carefully perused the materials available on record and this Court also carefully went through the order passed by the Court below.

3. The petitioner was the 4th defendant in the suit filed by the respondent/plaintiff. The said petitioner was set ex-parte on 07.11.2007. After nearly nineteen years, the petitioner filed an application to set aside the ex-parte order and the same came to be dismissed by the Court below.

4. In the considered view of this Court, the order passed by the Court below does not suffer from any perversity warranting interference of this Court. In the affidavit that has been filed in support of IA No.12 of 2026, there is not even a single reason assigned by the petitioner as to why there was a delay of nineteen years in filing the application. This Court is not inclined to resurrect

the right of the petitioner/4th defendant, which has already been buried long back.

5. In the result, this Civil Revision Petition stands dismissed. No Costs. Consequently, the connected miscellaneous petition is closed. 02-11-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SSR To The Principal Sub Ordinate Court, Hosur.
