PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned Refusal Check Slip in Refusal Number RFL/Kallikudi/57/2026 dated 30.09.2026 passed by the Respondent and quash the same as illegal, consequently directing the Respondent to register the Agreement Relating to Deposit of Title Deeds dated 29.09.2026 presented by the Petitioner.

ORDER
The present Writ Petition has been filed in the nature of a Writ of Certiorarified Mandamus challenging the impugned refusal check slip issued by the respondent, dated 30.09.2026 and to direct the respondent to register the deposit of title deed dated 29.09.2026 presented by the petitioner.
2. Heard Mr.A.Abdulkabur, learned Counsel for the petitioner and Mr.I.Pinaygash, learned Special Government Pleader, who accepts notice on behalf of the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.
3. From the perusal of the records, it is revealed that approval for the subject property/building had been granted by the local planning authority in favour of the petitioner. However, the impugned refusal check slip had been issued on the ground that the property is an unapproved property, which cannot be sustained. Hence, the impugned order is liable to be interfered with by this Court.
4. Accordingly, the Writ Petition stands allowed and the impugned refusal check slip issued by the respondent, dated 30.09.2026 stands set aside. The petitioner is permitted to re-present the subject document and on such re-presentation, the respondent is directed to proceed with the registration of the document, if it is otherwise in order.
