Hon’ble Mr. Justice Vivek Singh Thakur, Judge. Hon’ble Mr. Justice Bhupesh Sharma, Judge. Whether approved for reporting? 1 For the Appellant. Mr. Kulwant Singh Gill, Advocate. For the Respondent: Mr. Yashwardhan Singh Chauhan, Senior Additional Advocate General. __________________________________________________________

Vivek Singh Thakur, Judge This appeal has been filed by the appellant Lekh Ram @ Sunil Kumar through counsel Mr. Kulwant Singh Gill, Advocate on 04.01.2024, who had signed power of attorney in favour of learned counsel, which was duly attested by the Jail Superintendent on 24.08.2023.

2. Mr. Kulwant Singh Gill, Advocate, submits that the appellant was enlarged temporary on parole and during that period, he had taken file from him. 1 Whether the reporters of the local papers may be allowed to see the judgment?

Cr. Appeal No. 121 of 2024

3. At this stage, as pointed out by the Registry, another appeal, i.e., Criminal Appeal No. 179 of 2023, titled as Lekh Ram @ Sunil Kumar vs. State of Himachal Pradesh, filed prior in time on 24.04.2023 by the appellant, by giving Vakalatnama in favour of Mr. Bhupinder Singh Ahuja, Advocate on 25.02.2023, which was duly attested by the Presiding Officer, Special Judge (Fast Track POCSO Court), Mandi, District Mandi, H.P., is pending adjudication and has been listed for hearing on 22.12.2026. In that appeal also, appellant has handed over the case file to Mr. Yudhvir Singh Thakur, Advocate, after signing fresh power of attorney with no objection of Mr. Bhupinder Singh Ahuja, Advocate. The said power of attorney has also been attested by Jail Superintendent on 24.03.2026. Record has also been received in the said appeal.

4. In aforesaid circumstances, only one appeal has to be continued, which is prior in time and therefore, we are refraining ourselves from passing any adverse order against the appellant, as he is convict and is in detention, because he is serving sentence awarded to him. However, with observation that Jail Superintendent concerned is directed to advise the appellant not to file successive appeals, as filing of successive appeals would not only burden the Registry, but may also invite adverse order against him.

Cr. Appeal No. 121 of 2024

5. With the aforesaid observation, the appeal filed later in time, i.e., Criminal Appeal No. 121 of 2024, is closed and disposed of, being not maintainable. Pending miscellaneous application(s), if any, are also disposed of. (Vivek Singh Thakur),
