T.P:13/2026
Indian Overseas Bank V/S M/s Sri Kalaivani Spinners Pvt Ltd 03/11/2026
This petition is filed for transferring OA 103/2025 pending on the file of DRT, Coimbatore to any other DRT, within the jurisdiction of DRAT, Chennai.
2. Learned counsel for the petitioner submitted that Mr. N. Somasundaar, learned Presiding Officer, DRT, Coimbatore, had earlier defended the petitioner in WP No.5042/2023 before the Hon’ble High Court of Madras.
3. Learned counsel for the respondents submitted that the respondents have no objection for transferring the OA 103/2025 to any other Tribunal.
4. In the circumstances stated, this Tribunal is of the view that it is not appropriate for the present incumbent Presiding Officer Mr.N.Somasundaar, DRT, Coimbatore to decide the case in view of his appearance for the petitioner in WP 5042/2023 before the Hon’ble High Court of Madras earlier.
5. Thus, this transfer petition is allowed. Since the DRT, Madurai, is nearer to DRT, Coimbatore, this Tribunal directs that OA 103/2025 is to be transferred to DRT, Madurai for disposal in accordance with law.
6. The learned Presiding Officer, DRT, Coimbatore is directed to send the records to DRT, Madurai within a period one month from the date of receipt of a copy of this order. On receipt of all the records, the learned Presiding Officer, DRT, Madurai, is directed to take the case immediately, issue notice for the appearance of the parties and on their appearance, dispose the case as expeditiously as possible on merits and in accordance with law. In the result, this TP 13/2026 is allowed accordingly. Parties shall bear their own costs. Pending IAs, if any shall stand closed. Sd/-
