ORDER (ORAL)
Hon’ble Ms. Harvinder Kaur Oberoi, Member (J)
Learned counsel for the applicant submits that the applicant is aggrieved by the order dated 24.04.2026, whereby, after conducting a medical examination, the respondents declared him fit to resume his original duties.
2. The applicant is working as a Track Maintainer and claims that, owing to his medical condition, he is not in a position to discharge his duties as a Track Maintainer.
3. He further submits that, pursuant to the medical order dated 24.04.2026, the applicant preferred an appeal against the same on 28.04.2026, which is still pending consideration.
4. In the meantime, the applicant got himself admitted to the Northern Railway Central Hospital. In this regard, he has placed on record the relevant medical documents, including discharge summary dated 21.08.2026.
5. A perusal of the discharge summary indicates that, although the applicant was found clinically and radiologically fit, he was advised further follow-up and medical physiotherapy.
6. Learned counsel for the applicant submits that the subsequent event of the applicant's admission to the Northern Railway Central Hospital on 10.08.2026 and his discharge on 21.08.2026 demonstrates that he is not medically fit to discharge his duties as a Track Maintainer. He, therefore, submits that, in view of the two medical opinions rendered at different points in time, the matter requires reconsideration. ARTI
