ORDER (ORAL)
Hon’ble Ms. Harvinder Kaur Oberoi, Member (J)
Learned counsel for the applicants submits that the applicants are aggrieved by the action of the respondents, who, according to him, have not followed the prescribed roster while conducting the Departmental Promotion Committee (DPC) and have promoted certain individuals in excess of their respective positions in the roster.
2. He further submits that the DoPT instructions mandate the maintenance of a roster and that promotions are required to be effected strictly in accordance with the roster.
3. Upon a query from the Bench as to whether the roster is required to be maintained in view of the issue pending consideration before the Hon’ble Supreme Court in Jarnail Singh's case, particularly in view of the interim directions permitting the respondents to continue making promotions from the unreserved category to the unreserved category and from the reserved category to the reserved category, learned counsel for the applicant seeks some time to obtain instructions in this regard.
4. At this stage, learned counsel for the applicant seeks permission to withdraw the present Original Application with liberty to file a better-drafted petition incorporating all the subsequent legal developments. He further seeks liberty to ARTI
