1. Heard Ms. S Anuradha, learned counsel for the applicant.

2. The applicant’s husband, Trackman under the Section Engineer, Peddapalli, was removed from service on 27.11.2006 pursuant to departmental proceedings arising out of his arrest in a criminal case. The departmental inquiry was conducted ex parte and the charge was held proved. However, he was subsequently acquitted in the criminal case on the same set of facts and evidence.

3. He sought reinstatement/review of the penalty, relying upon Railway Board instructions dated 07.06.1995 regarding review of departmental proceedings following acquittal on merits. His appeal and subsequent representations were not favourably considered, leading him to file O.A.No.175/2016. By order dated 19.06.2024, the Tribunal directed the respondents to consider his representation and the claim for notional reinstatement and consequential pensionary benefits, if otherwise eligible.

4. The employee unfortunately died on 18.06.2024. Thereafter, the applicant pursued the matter through several representations. The respondents passed an order dated 21.08.2025, which the applicant challenged, by submitting representation dt.05.09.2025 contending that the matter was improperly dealt with by the Engineering Department and that the penalty was confirmed by referring to an earlier absence which was unrelated to the disciplinary proceedings in question. Hence, the present O.A.

5. Mr. Parmeshwar Reddy, learned Counsel accepts notice on behalf of the respondents.

6. List the case on 30.12.2026 before Registrar’s Court for completion of pleadings.
