CENTRAL ADMINISTRATIVE TRIBUNAL BANGALORE Order Sheet Item no.: 6 O.A./249/2025 (BANGALORE) [ TRANSFER ] Court No.: 2 No of Adjournment: 21 Order Dated: 04/11/2026 GANESH PADANKATTI Vs SOUTH WESTERN RAILWAY
For Applicant(s) Advocate : Shri Chandan S Malapur For Respondent(s) Advocate : Shri H R Sreedhara - through video conference Order of The Tribunal Shri Chandan S Malapur on behalf of the applicant. Shri H R Sreedhara on behalf of the respondents through video conference. Arguments commenced but not concluded. Learned counsel for the applicant argues that the impugned order of transfer dated 21.03.2025 was issued in violation to the Rule No. 4.2 and Rule No. 13.5 of the Master Circular dated 17.08.2023. He also invites my attention to Para No. 10 of the affidavit dated 17.07.2026 filed by the counsel for the respondents which says that they were not maintaining any records pertaining to the decision making process leading to the issuance of the impugned Transfer order. He also submits that in ordersheet dated 25.06.2026 of the DB in Court No. 1, it is observed that the sealed cover furnished by Respondent No. 1 had no relevance and the same were returned. It is seen that this case was heard from 02.06.2025 till 25.06.2026 i.e. for more than one year spread over 14 adjournments by DB in Court No. 1 and thereafter, it has been transferred to this SMB. To appreciate the contextual background and the developments as transpired in the Court No. 1 over the fist 14 adjournments, following orders are issued:
(i) Learned counsel for the applicant will furnish written notes of arguments, which should also include the entire chronological sequence of events which he orally mentioned in the Court.
(ii) Likewise, learned counsel for the respondents will also furnish written notes of arguments along with the sealed cover, which he had earlier submitted to the DB of Court No. 1 to get a better appreciation of the whole case. Learned counsel for the applicant has assured that he will furnish a copy of the notes to the counsel for the respondents before 20.11.2026, based on which the counsel for respondents submits that he will submit his written notes of arguments in the subsequent one week. List the case for final arguments on 04.12.2026.
