Learned Sr. Counsel for the applicant has stated that in terms of advertisement notification No. 05 of 2021 dated 22.09.2021 under item No. 704, the name of the applicant figures in the final seniority list dated 06.06.2023 under SC category.
2. It is further submitted by learned Sr. Counsel that mark sheet/diploma certificate in Horticulture of the applicant has been verified by the concerned institute as per Annexure A/7 and despite the communication dated 22.04.2026 of Respondent No.
department, no steps have been taken by the Respondent No. 1-Board to take further action with regard to withheld recommendations for the post of Horticulture Technician Grade-IV.

Mr. Rajesh Thapa, learned A.A.G. appearing for the respondents on advance notice stated that a Committee has been constituted by Board regarding withheld recommendations for the aforesaid post to verify the recognition status and the Committee is expected to submit its report within a week's time for placing the same for Board meeting for final decision.
4. Learned Sr. Counsel for the applicant submitted that this O.A. may be disposed of with direction to Respondent No. 2 (J&K SSB) to treat a copy of this O.A. as representation of the applicant and take a decision in accordance with communication dated 22.04.2026 of Respondent No.
department with regard to withheld recommendation of the applicant.

5. Mr. Rajesh Thapa, learned A.A.G. appearing on behalf of the respondents seeks sometime to file reply.
6. Having heard the learned counsel for the parties, we are of the considered view that no useful purpose would be served in keeping this O.A. pending and same can be disposed of.
7. Accordingly, this O.A. is disposed off, at the admission stage itself, without entering into the merits of the case, with a direction to respondent No. 2 to treat a copy of this O.A as representation of the applicant and take a decision in accordance with communication dated 22.04.2026 of Respondent No. 1 department with regard to withheld recommendation of the applicant by passing a reasoned and speaking order within a period of three weeks from the date of receipt of a certified copy of this order. A copy of the speaking order shall also be communicated to the applicant.
8. There sha ll be no orders so as to costs.
