MA./834/2026: This is an application seeking production of certain documents touching the confidential reports in respect of a few third parties. Applicant wants to highlight that he has been discriminated against in recording his APAR. Learned Standing Counsel has opposed the application. According to him no comparison is possible between two employees, always relative merits is there in the matter of recording confidential reports of employees. He also pointed out with reference to Annexures R-2 and R-3 that the applicant had faced disciplinary proceedings and suffered punishments. But according to the learned Counsel for the applicant, persons who suffered major penalties have been favoured while recording their confidential reports, that the production of records is sought for exposing the double standards of the authorities. At this juncture, without going into the merits of the rival contentions, the respondents are directed to produce the documents as sought for in a sealed cover, which shall be opened only it found necessary, at the appropriate time. Accordingly, the M.A. is disposed of. Post on 02.12.2026. Records shall be produced by the next date of posting.
