ORDER
The applicant was discharged at own request on 30.09.2001. He was in a permanent low medical category on account of disability of ‘Traumatic Synovitis (RT) Knee’, the extent of which was assessed to be 20% for 02 years and aggravated by military service. Claim for grant of disability element was rejected because discharge was at own request.
Learned counsel for the applicant has relied upon Government Policy letter dated 19.05.2017 whereby the Union of India has agreed to grant disability benefits to even those who had been discharged at own request, however, w.e.f. 01.01.2006. Rejection of demand dated 03.10.2025. He further submits that the representation dated 10.03.2025 may be treated to be a request for grant of disability element only. Notice.
Mr. Jagjot Singh Lalli, Deputy Solicitor General of India accepts notice on behalf of respondents and waives service and accepts that in accordance with Government Policy letter dated 19.05.2017, the applicant would be entitled to grant of disability element w.e.f. 01.01.2006 provided the extent of his disability continued to be 20% or higher.
OA 965 of 2026 Lakhwinder Singh Vs UOI & Ors. …2/- Under these circumstances, we are of the considered opinion that in the first instance, the respondents be directed to conduct a Re-Assessment Medical Board (RAMB). Claim of the applicant be re-examined thereafter. RAMB must be conducted within six months from the date of receipt of certified copy of this order by the learned counsel for respondents/OIC Legal Cell. Decision whether to grant disability element or not w.e.f. 01.01.2006 shall be taken within two months thereafter. The applicant shall be kept informed of the progress of the case. Adjourned to 16.04.2027.
