ORDER
AIR MARSHAL MANAVENDRA SINGH, MEMBER (A).
The applicant has filed this Original Application under Section 14 of AFT Act, 2007 for grant of MACP w.e.f. 31.07.2025 and pensionary benefits w.e.f 01.08.2025 with all consequential benefits.
2. The applicant was enrolled in the Indian Army on 31.07.2001 and was discharged on 31.07.2025 on fulfilling the conditions of enrolment after rendering 24 years of service. However, he has not been granted the benefit of MACP on the date of retirement. The learned counsel for the applicant submits that the applicant was promoted to the rank of Havildar on 01.05.2019 and thus had served for 06 years and 03 months in the rank of Havildar before retirement on 31.07.2025.
3. As the applicant had not served for 08 years in the same rank, hence he is not found eligible for grant of MACP on completion of 24 years service. Accordingly, the case has no merit and is disposed of in limine.
