IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA.

CWP(T) No. 10322 of 2008.

Decided on: 29th December, 2010. Sanam Wangial Negi and Others. …Petitioners.

-Versus- State of H.P. and Others.

…Respondents.

Coram:

The Hon’ble Mr. Justice Rajiv Sharma, Judge. Whether approved for reporting?1 __________________________________________________________ For the petitioners. : Mr. P.P. Chauhan, Advocate. For the respondents. : Mr. Vinod Thakur, Deputy

Advocate General with Mr. R.P.

Singh, Assistant Advocate

General. ---------------------------------------------------------------------------------------- Rajiv Sharma, Judge (Oral):

The pay of the petitioners was enhanced. However, the same was withdrawn vide Annexures A-2 and A-3, dated 14.10.2003 and 10.11.2003. Admittedly, the petitioners have not been heard before the issuance of Annexures A-2 and A-3, dated 14.10.2003 and 10.11.2003. They have been visited with civil and evil consequences. Their pay has been reduced. The petitioners have neither misled nor played any fraud upon the respondents at the time of granting them revised/enhanced pay.

2. Consequently, the petition is allowed. Annexures A- 2 and A-3, dated 14.10.2003 and 10.11.2003 are quashed and set aside. However, liberty is reserved to the respondents to proceed with the matter in accordance with law. The petition stands disposed of. No costs.
