ORDER
Heard both sides.
2. This order is to be read in continuation of the earlier orders dated 23.10.2026 in WP(MD)No.30389 of 2026 and the order dated 04.11.2026 made in this contempt petition.
3. I make it clear that I have not laid down any law in this case. Since the State Government chose to abide by the order made in WP(MD)No.35902 of 2026 dated 03.09.2026 and WP(MD)Nos.37032 of 2026 and 37325 and 37326 of 2026 dated 24.09.2026, I felt that the State Government would not be justified in adopting a different yardstick in this case alone. When in the case of four candidates, the State Government accepted the percentage of the Bench Mark Disability set out in the UDID card, there is no reason in not adopting the very same approach in this case. However, this order should be understood as having endeavoured to grant relief to the petitioner herein. My order shall not be understood as subscribing to the ratio laid down in the
CONT P(MD) No. 3648 of 2026 aforesaid four cases. I issue this clarification to address the apprehension expressed by the learned Additional Advocate General that flood gates may be opened. Be that as it may, following the direction given by this Court, the petitioner herein had registered herself in the special stray vacancy round. She had made necessary payments. Choice locking also has also been done.
4. Direction is given to the third respondent to consider the case of the petitioner as eligible to participate in the Special Stray Vacancy round for MBBS – 2026. Allotment of seat to the petitioner will depend upon her merit ranking. The petitioner shall be considered against the All India quota.
5. This contempt petition is closed with the aforesaid direction. 05-11-2026 SKM To
