ORDER
The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking for a direction to the third respondent to consider the petitioner’s representation dated 11.08.2026 and forbear the 3rd respondent from register any encumbrance presented by any person in respect of the properties situated in S.Nos.630/2, 630/6, 630/13, 631/1, 632/1 and 633/1 at Ampalapattu Village, Orathanadu, Thanjavur District till the disposal of the petitioner’s application pending before the 1st respondent in Na.Ka. No.4420594/2026/Vu(3) dated 06.04.2026.
2. Heard the learned Counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.
3. It is to be noted that on the strength of an application for UDR correction pending before the first respondent, the present Writ Petition has been filed seeking for a direction not to register any document in respect of the subject property. However, this Court is of the view that mere pendency of an application for correction of UDR proceedings before the District Revenue Officer cannot be a ground to reject/refuse registration of a document, if it is properly presented. WP(MD) No. 31591 of 2026 authority could only be prevented from entertaining a document on the basis of an order passed by a competent civil Court and not otherwise.
4. In such view of the matter, this Court finds no merits in the present Writ Petition. However, considering the fact that the petitioner’s application for correction of UDR proceedings is pending before the first respondent, this Court is inclined to issue the following directions: “the first respondent is directed to consider the application submitted by the petitioner in Na.Ka. No.4420594/2026/Vu(3) dated 06.04.2026 on merits and after affording sufficient opportunity of hearing to the petitioner as well as to all the parties concerned shall pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.”
