PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the Respondents No.1 to 3 to survey the petitioner’s properties and fix boundary stones in respect of Natham Survey No. 104/47 to an extent of 0.0.5800 Ares situated at Pannaikudi, Atchampatti Post, Alanganallur Via, Vadipatti Taluk, Madurai District, under the supervision of the 4th Respondent for surveying the land, based on the petitioner’s representation dated 05.08.2026 within a time frame to be stipulated by this Court.

ORDER
The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking a direction against the Respondents No.1 to 3 to survey and fix boundary stones in respect of the subject property by considering the petitioner’s representation dated 05.08.2026 within a time frame to be stipulated by this Court.
2. Heard the learned Counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage. In view of the order proposed to be passed, notice to the private respondent is dispensed with.
3. The petitioner submitted that he is the owner of the subject property and in order to survey and fix the boundaries to the subject property, he had made an application on 05.08.2026 and since no further steps have been taken by the revenue authorities, the petitioner has filed the present Writ Petition with the above relief. __________

Considering the facts and circumstances of the case and also considering the fact that the application of the petitioner is pending from 05.08.2026, this Court is inclined to issue the following directions: “The third respondent is directed to process the application of the petitioner, dated 05.08.2026 on merits and pass appropriate orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. If necessary, the third respondent can seek assistance of the fourth respondent at the time of surveying, who in turn, shall provide adequate police protection at the cost of the petitioner.”
5. It is made clear that the order passed and the proceedings undertaken pursuant thereto would not confer any right to possession of the property if the same is in the hands of third parties.
