PRAYER: This Petition filed under Section 528 of BNSS to call for the records relating to the order dated 07.10.2026 in Crl.M.P. No. 3038 of 2026 in C.A. No. 328 of 2026 in S.T.C. No. 943 of 2024 on the file of the Learned Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur, set aside the same insofar as the condition No.1 regarding the payment of deposit amount of Rs.10 lakhs alone and extend the time for depositing the amount before the learned Judicial Magistrate No.1, Sivakasi.

This Criminal Original Petition has been filed by the appellant in C.A.No.328 of 2026 on the file of the Learned Principal District and __________

CRL OP(MD) No. 25419 of 2026 Sessions Judge, Virudhunagar District at Srivilliputhur, seeking to set aside the order passed in Cr.M.P.No.3038 of 2026, wherein the appellate Court has directed the petitioner to deposit a sum of Rs.10 lakhs as a condition precedent for suspension of sentence within a period of 30 days.
2. According to the learned counsel appearing for the petitioner, the petitioner is a Tailor by profession and he has proposed to undergo implant surgery by orthopaedic and in such circumstances, he seeks extension of time for depositing the amount of Rs.10 lakhs.
3. Considering the medical records of the petitioner and the request made by him, time granted by the appellate Court is extended till 31.12.2026.
