ORDER

(Order of the Court was made by M. NIRMAL KUMAR J.) This petition has been filed to direct the respondents 1 and 2 to produce the body or person of the detenue namely Narmatha (aged 31) W/o Karuppaiah before this Honble Court and set her at liberty forthwith.

2. It is the case of the petitioner that his wife was found missing from 08.10.2026. Therefore the petitioner lodged complaint before the second respondent police. The respondent police based on the complaint registered a case in Crime No.416 of 2026 under 'Women missing '. The petitioner has also sent a representation to the Superintendent of Police. The petitioner had two children aged about 7 and 3 years respectively and the children are in depressed mood and crying to see their mother and to have their love. Further her mobile phone has been switched off. When she was found missing she had some jewels with her. Since no steps have been taken to secure the missing person, the present petition has been filed.

3. The learned Additional Public Prosecutor submitted that on the complaint given by the petitioner a case in Crime No.416 of 2026 under 'Women missing ' was registered. During investigation the respondent __________

HCP(MD) No. 1430 of 2026 police found the tower location shows at Kodaikanal. Information has been received that mother of one Suriya Kannan had lodged a complaint before the Cholavandhan Police Station stating that her son had eloped with the wife of the petitioner and CSR No.375 of 2026 was assigned on 31.10.2026. The police has gone to Kodaikanal and now the mobile phones have been switched off and soon they will be secured.

4. From the averments it is seen that there is no illegal detention. The wife of the petitioner is major and she on her own volition had left the home hence the present Habeus Corpus Petition would not arise.

5. In view of the same, the petition stands closed. This Court would normally impose costs in such circumstances, considering the fact that the learned counsel is a young member of the Bar who has recently enrolled, this Court refrains from imposing costs.
