ORDER

This Writ Petition has been filed seeking a direction to the 2nd respondent to rectify the errors in the revenue records in respect of the properties comprised in Old Survey No.724/17A and New Survey Nos.1070/15, 1070/16, 1070/17, 1070/18 and 1070/21, situated at Manimangalam Village, Kundrathur Taluk, Kancheepuram District, by considering the petitioners' representation, lastly dated 29.07.2026.

2. The case of the petitioners is that they have been in continuous possession and enjoyment of their respective Grama Natham properties comprised in New Survey Nos.1070/15, 1070/16, 1070/17, 1070/18 and 1070/21, situated at Manimangalam Village, for more than five decades. However, during the UDR proceedings, the properties were erroneously classified as Wakf Board lands. Taking advantage of the erroneous entries, the Mosque is attempting to interfere with their peaceful possession and enjoyment. Though the petitioners submitted a representation dated 29.07.2026 and several subsequent reminders to the 2nd respondent, seeking rectification of the revenue records and issuance of patta in their favour, no action has been taken. Hence, the present writ petition.

W.P.No.44118 of 2026

3. The learned counsel appearing for the petitioners would submit that the petitioners have been in continuous possession and enjoyment of their respective portions of the Grama Natham properties for more than five decades. It is further submitted that, during the UDR proceedings, an erroneous entry was made in the revenue records by classifying the petitioners' properties as Wakf Board lands, whereas the Mosque's property is situated in a different survey number, namely, New Survey No.1070/2, measuring 53 cents. Taking advantage of the erroneous entry, the Mosque is attempting to interfere with the petitioners' peaceful possession and enjoyment of their respective properties. Though the petitioners submitted a representation dated 29.07.2026, followed by several reminders, seeking rectification of the revenue records and issuance of patta in their favour, the 2nd respondent has not taken any action. Hence, the learned counsel sought appropriate directions to the respondents to rectify the errors in the UDR records and issue patta in favour of the petitioners in accordance with law.

4. The learned Additional Government Pleader appearing for the respondents one to three submitted that the rectification proceedings will be concluded expeditiously if a specific time frame is fixed by this Court.

W.P.No.44118 of 2026

5. In view of the submissions made on either side and taking into consideration the facts and circumstances of the case, this Court, without expressing any opinion on the merits of the case, directs the 2nd respondent to conduct an enquiry into the petitioners' representation dated 29.07.2026, after affording due opportunity of hearing to the petitioners, 4th respondent and other interested parties. The authority shall verify the relevant revenue records and other supporting documents and consider the petitioners' representation dated 29.07.2026, seeking rectification of the UDR entries and issuance of patta, on its own merits and in accordance with law. The entire exercise shall be completed and appropriate orders shall be passed by the competent authority within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner. If there is any dispute relating to the title or inter-se civil rights over the property, the parties are at liberty to approach the competent Civil Court for appropriate relief. With the above directions, this Writ Petition stands disposed of. No costs. 04.11.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vv2
