ORDER
This Writ Petition has been filed seeking a direction to the respondents 1 and 2 to survey and demarcate the petitioner's property, fix boundary stones with the assistance and protection of the 3rd respondent Police, and consequently issue patta in respect of the property measuring 1,207.5 sq.ft., comprised in Old Survey No.85/18 (New Survey No.85/18A5), situated at Veerakkalpudur Village, Mettur Taluk, Salem District, in accordance with the registered Sale Deed dated 08.05.2002, registered as Document No.541 of 2002, by considering the petitioner's applications bearing Appl. Nos.2026/0123/08/007058, dated 12.10.2026, and 2026/0105/08/054531, dated
26.08.2026.
2. The case of the petitioner is that he is the owner of the property comprised in Old Survey No.85/18 (New Survey No.85/18A5), having purchased the same under a registered Sale Deed dated 08.05.2002, registered as Document No.541 of 2002. The petitioner further submits that he has submitted an online Appl.No.2026/0123/08/007058 dated 12.10.2026 and Appl.No.2026/0105/08/054531 dated 26.08.2026, seeking survey of the subject property and fixation of boundary stones. The 4th and 5th respondents have no right, title or interest over the petitioner's property and are merely adjacent landowners. Therefore, no prejudice would be caused to them if the competent authorities conduct a survey, demarcate the boundaries, fix boundary stones and issue patta in respect of the petitioner's property. However, the respondents have not taken appropriate action on the petitioner's application. Hence, the petitioner has approached this Court by way of the present writ petition.
3. The learned counsel appearing for the petitioner submitted that the petitioner had purchased the subject property under a registered Sale Deed dated 08.05.2002 and had subsequently submitted an online application seeking survey and demarcation of the property and fixation of boundary stones. It is further submitted that the 4th and 5th respondents are only adjacent landowners and have no right or interest over the petitioner's property. Therefore, their interests would not be affected by conducting the survey and demarcating the petitioner's property. Hence, the learned counsel sought a direction to the respondents to consider the petitioner's application, conduct a survey, fix boundary stones and issue patta in accordance with law.
4. The learned Additional Government Pleader appearing for the respondents 1 & 2 would submit that if a specific time frame is fixed by this Court, the 1st respondent will consider the petitioner’s applications and pass appropriate orders on its own merits in accordance with law.
5. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 & 2 and the learned Government Advocate (Criminal Side) appearing for the 3rd respondent.
6. In view of the limited nature of the order proposed to be passed and the relief sought, notice to the respondents 4 & 5 is dispensed with, and this Writ Petition is taken up for final disposal at the admission stage itself.
7. Without going into the merits of the property claims made by either side, this Court deems it appropriate to dispose of the matter by directing the 1 st respondent to entertain the petitioner’s Appl.No.2026/0123/08/007058 dated 12.10.2026 and Appl.No.2026/0105/08/054531 dated 26.08.2026 and conduct a fresh, field survey and boundary demarcation of the petitioner’s land, which is the subject property herein. The 1st respondent shall direct the 2nd respondent to measure the property strictly in accordance with the relevant Field Measurement Book (FMB) sketches, revenue records and the parental title deeds of the parties. The 1st respondent is directed to issue notice to the petitioner as well as to the respondents 4 & 5 and any other counter-claimants or adjacent land- owners, fixing the exact date and time for the physical inspection and measurement. Both the petitioner and the respondents 4 and 5 shall be given a fair and full opportunity to place their objections, representations, and title documents before the surveying authority at the time of inquiry.
8. The entire exercise, including the physical measurement of the property, the fixation of boundary stones, and the passing of a reasoned final operational order on the petitioner’s application, shall be completed by the 1st respondent within a period of eight weeks from the date of receipt of a copy of this order. It is needless to say, in the event, any obstruction is being caused by any third parties, the respondents 1 and 2 are at liberty to seek the assistance of the 3rd respondent to render all kinds of assistance, as required, by the Revenue Official for demarcation of the subject property.
9. With the above directions, this Writ Petition is disposed of. No costs. 04.11.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vv2 To
