PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to expeditiously hear and dispose of Opposition No. 990704 filed by the 2nd Respondent against the Petitioners Application No.3436700 for the mark "HEALTHIUM" (word) in classes 05 and 10 and to consequently, dispose of the Petitioners Application No. 3436700 within such time as may be fixed by this Court.

ORDER
Heard Mrs.Meera Moganasundaram, learned counsel for the petitioner and Mr.J.Madanagopal Rao, learned Senior Central Government Standing Counsel takes notice for the first respondent. Considering that the relief sought for in the Writ Petition is limited in scope, I hereby dispense with notice to the second respondent.

The learned counsel for the petitioner would submit that the 1st respondent has to expeditiously hear and dispose the Opposition No. 990704 filed by the 2nd Respondent against the Petitioners Application No.3436700 for the mark "HEALTHIUM" (word) in classes 05 and 10 and to consequently, dispose of the Petitioners Application No. 3436700, within a stipulated time.
3. The grievance of the petitioner is that the Opposition is pending from 2019 onwards and hence, the petitioner seeks for limited relief for expedite hearing and final disposal of the Opposition Application, so that the petitioner will be in a position to proceed further with the registration of the word mark "HEALTHIUM" (word) in classes 05 and 10.

The learned Senior Central Government Standing Counsel for the first respondent Mr.J.Madanagopal Rao, would submit that this Court can pass suitable directions directing the first respondent to hear both the petitioner and the second respondent and dispose of the Opposition No. 990704, on merits within a reasonable period of time.

Considering that the Opposition Application No. 990704, has been pending from 2019, I direct the first respondent to hear the petitioner and the second respondent and dispose of the Application in Opposition No. 990704, in accordance with law and on merits, within a period of four (4) weeks from the date of receipt of the copy of the order. Subject to the orders that may be passed in the Opposition Application, the petitioner's Application shall be thereafter disposed of, on merits, within a period of twelve (12) weeks.
6. With the above directions, this Writ Petition is allowed.
