6. By the impugned order, the Court below dismissed the said application on the ground that by virtue of the amendment, the petitioners/plaintiffs introduced new facts, altered the cause of action and sought for a larger relief and thereby attempted to alter the very structure of the plaint. Aggrieved by that, the above revision has been filed before this Court.

7. On a plain reading of the averments extracted supra that have been pleaded by the petitioners/plaintiffs,, it can be seen that the petitioners/plaintiffs are now attempting to come up with new facts by altering the cause of action and also seeking for a substantive relief. This has been done post trial and therefore, the Proviso to Order VI Rule 17 of the CPC will also come into play. As rightly found by the Court below, such an amendment cannot be permitted. This is more so since P.W.1 had not subjected himself to cross examination and the petitioners/plaintiffs realized that the said suit, in its present form, may not be able to be prosecuted.

8. As the petitioners/plaintiffs decided to seek for substantive relief by bringing in new facts, instead of making such an attempt by amending the plaint, they can always seek for withdrawal of the said suit and file a fresh suit seeking for a substantive relief. That will be the correct course of action to be adopted by the petitioners/ plaintiffs. It is made clear that this observation, by itself, will not give any cause of action to the petitioners/plaintiffs and it is only a thought that crossed the mind of this Court while disposing of the above revision.

9. In the light of the above, the civil revision petition is dismissed and the impugned order dated 10.7.2026 passed in I.A.No.7 of 2026 in O.S.No.91 of 2021 on the file of the Principal District Munsif Court, Tiruvannamalai District stands confirmed. No costs. Consequently, the connected CMP is also dismissed.
