ORDER

This Writ Petition has been filed seeking a direction to the 2nd respondent to survey and measure the petitioner’s agricultural land measuring 0.01.00 hectares, comprised in Survey No.190/4A2, Ulliyakudi Village, Jayamkondam Taluk, Ariyalur District, after affording an opportunity to respondents 3 to 5 and, if necessary, seeking police protection from the 6th respondent, pursuant to the petitioner’s representation dated 09.02.2026, within a time frame to be stipulated by this Court.

2. The petitioner purchased an extent of 0.01.00 hectares of agricultural land in Survey No.190/4A2, Ulliyakudi Village, Jayamkondam Taluk, Ariyalur District, from the 3rd respondent under a registered Sale Deed dated 14.10.2011, bearing Document No.1262/2011, registered at the Sub-Registrar Office,

W.P.No.22923 of 2026

Vikramangalam. Pursuant thereto, a separate patta bearing No.364 was issued in his favour, and he has been in continuous possession and enjoyment of the property. Since the neighbouring landowners, namely, respondents 3 to 5, raised disputes alleging encroachment upon their lands, the petitioner submitted an online application on 30.12.2023, along with the prescribed fee, seeking survey and measurement of his property. Though the 2nd respondent measured the property in February 2025, the same was done in the absence of respondents 3 to 5. Therefore, the petitioner remitted a further sum of Rs.2,000/- on 30.01.2026 and submitted a representation dated 09.02.2026, requesting a fresh survey and demarcation of the property in the presence of the neighbouring landowners. However, despite receipt of the representation and repeated follow-ups, no action has been taken by the 2nd respondent. Hence, the present Writ Petition.

3. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property, having purchased the same under a registered Sale Deed, and a separate patta has also been issued in his favour. Owing to the objections raised by the neighbouring landowners, the petitioner seeks a proper survey and demarcation of his property in the presence of respondents 3 to 5. Though the petitioner has remitted the requisite survey charges and submitted a representation dated 09.02.2026, the 2nd respondent has

failed to conduct the survey. Hence, the petitioner has approached this Court seeking appropriate directions.

4. The learned Government Advocate appearing for the respondents 1 & 2 would submit that if a specific time frame is fixed by this Court, the 2nd respondent will consider the petitioner’s representation and pass appropriate orders on its own merits in accordance with law.

5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate appearing for the respondents 1 & 2 and the learned counsel appearing for the 3rd respondent.

6. Without going into the merits of the property claims made by either side, this Court deems it appropriate to dispose of the matter by directing the 2nd respondent to entertain the petitioner's representation dated 09.02.2026 and conduct a fresh, field survey and boundary demarcation of the petitioner’s land, which is the subject property herein. The 2nd respondent shall direct the concerned Surveyor to measure the property strictly in accordance with the relevant Field Measurement Book (FMB) sketches, revenue records and the parental title deeds of the parties. The 2nd respondent is directed to issue notice to the petitioner as well as to the respondents 3 to 5 and any other counter-

claimants or adjacent land-owners, fixing the exact date and time for the physical inspection and measurement. All the objections raised by the respondents 3 to 5 including the grounds stated in the counter, may be raised and considered during the survey proceedings.

7. The entire exercise, including the physical measurement of the property, the fixation of boundary stones, and the passing of a reasoned final operational order on the petitioner's representation, shall be completed by the 2nd respondent within a period of eight weeks from the date of receipt of a copy of this order.

8. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner. It is needless to state that any dispute or grievance of the petitioner concerning the title, ownership, rights over the property or ingress and egress shall be agitated before the competent Civil Court, and the same shall be subject to its jurisdiction. With the above directions, this writ petition is disposed of. No costs. 03.11.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vv2
