Order

(Order of the Court was made by S.M.Subramaniam J.) This writ of mandamus has been instituted for directing the respondents 1 to 3 to consider my representation dated 21.07.2025 for removal of encroachment made in survey no.36 which was classified as Pattai (public pathway) at Ravathanallur village, Vanapuram Taluk, Kallakurichi District within a time frame fixed by this Court.

2. The Revenue Tahsildar, Vanapuram Taluk has addressed a letter to the Government Pleader on 01.11.2026. A reading of the written instructions given by the Tahsildar would show that Survey No.36 as stated by the petitioner has been classified as "Paathai Poramboke". However, the Government has already assigned the said land in favour of nine homeless poor persons for construction of dwelling houses. They have constructed houses and are residing there. In respect of S.No.36/1, learned Government Advocate submits that it is earmarked as ‘pathway’ and the authorities have not identified any encroachment in the pathway.

WP No. 44256 of 2026

3. Learned counsel for the petitioner submits that in between a small portion of the land, which is also Government Poramboke land, there are encroachments and the same alone is to be removed since the petitioner is using the same as pathway to reach his lands. In this regard, the Tahsildar has stated that the petitioner, no doubt, was using the said land as pathway. But, the said land was already assigned in favour of homeless poor persons and Patta has also been granted.

4. In view of the above facts and circumstances, this Court is of the considered view that this writ petition is unnecessary and therefore the same stands dismissed. No costs. (S.M.S.,J.) (R.R.V.,J.) 03-11-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST To
