Order
(Order of the Court was made by S.M.Subramaniam J.)
Writ of Mandamus has been instituted to direct the respondents to dispose of the representation / complaint given by the petitioner on 21.10.2026. Curiously, the petitioner sent the representation on 21.10.2026 and filed the writ petition within a period of five days of filing the complaint ie., on 26.10.2026. Once a complaint is filed for initiation of action to deal with the unauthorised constructions, the authorities must be provided some reasonable time to take appropriate action in the manner known to law. Coimbatore Corporation consists of a vast area and the complaints are to be addressed in a sympathetic manner. No doubt, the authorities are expected to deal with the complaint within a reasonable period of time. However, filing
WP No. 44948 of 2026
of a writ petition within a period of five days from the date of complaint cannot be appreciated.
2. High Court cannot give a direction to dispose of the representation in a routine manner. Such directions, in the absence of any right, would do no service to the cause of justice. It will only result in multiplicity of litigation. Therefore, in such circumstances where complaint has been lodged, the authorities must take appropriate action within a reasonable time to deal with the complaint. No doubt, in certain urgent circumstances if any immediate action is required, the authorities are expected to act swiftly. However, the petitioner has filed a complaint on 21.10.2026 and the authorities shall look into the same and take action in the manner known to law. Since the petitioner has not even granted breathing time to the authorities to deal with the complaint, we are not inclined to entertain the writ petition.
3. The practice of filing such writ petition cannot be encouraged by this Court. While recording the fact that the authorities have to initiate appropriate action on the complaint dated 21.10.2026, this Court is inclined to impose costs of Rs.10,000/- (Rupees Ten Thousand Only) to be paid to Tamil Nadu Advocate Clerks' Association, Indian Bank, High Court Branch, Account No. 484026006, IFSC Code: IDIB000M157 on or before 12.11.2026.
WP No. 44948 of 2026
3. Accordingly, the writ petition stands dismissed. Connected miscellaneous petitions are closed. Post the writ petition for reporting compliance on 13.11.2026. (S.M.S.,J.) (R.R.V.,J.) 03-11-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST To
