ORDER

(Made by A.D.JAGADISH CHANDIRA J.) This Writ Petition (Criminal) has been filed seeking a direction to the respondents to grant 30 days ordinary leave to the petitioner’s husband based on her representation dated 28.09.2026.

2. The case of the petitioner is that her husband, Mani @ Manikandan (Prisoner No.4954), was convicted and sentenced to life imprisonment pursuant to the judgment dated 05.04.2000, passed in S.C.No.15 of 1999, on the file of the Principal Sessions Court, Puducherry, which was subsequently confirmed by this Court. The petitioner had sent a representation dated 28.09.2026, to the respondents seeking ordinary leave for her husband/convict prisoner, who has been incarcerated for a period of 27 years, to enable him to make necessary arrangements for construction of their house and to facilitate better school admissions of their children. However, since the respondents have not taken any action, the petitioner has filed the present Writ Petition (Criminal) before this Court.

3. Though several grounds have been raised in the writ petition, the learned counsel for the petitioner submitted that it would suffice if this Court directs the respondents to consider the petitioner’s representation dated 28.09.2026 and pass appropriate orders as expeditiously as possible.

4. Learned Public Prosecutor (Puducherry) appearing for the respondents submitted that the petitioner’s representation dated 28.09.2026 would be duly considered and appropriate orders would be passed within the time stipulated by this Court.

5. In view of the above, this Court, without going into the merits of the case, directs the respondents to consider the petitioner’s representation dated 28.09.2026 and pass appropriate orders on merits and in accordance with law, within a period of three (3) weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition (Criminal) stands disposed of. No costs. (A.D.J.C.,J.) (B.K.,J.) 03-11-2026 Neutral Citation: Yes/No ham
