PRAYER: (S-27) Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st respondent to treat the period from 08.11.2011 to 27.06.2022 as duty period and disburse the salary arrears and other consequential benefits payable to the petitioner within a stipulated time and pass any other appropriate order or relief as this Honble Court may deem fit in the circumstances of the case and thus render justice.

The petitioner, a Salesman in DD 534 Kampalipatti Primary Agricultural Co-operative Credit Society Ltd, Dindigul District was dismissed from service on 08.11.2011, without conducting proper enquiry. Therefore, the petitioner has filed a writ petition in WP(MD) No.14743 of 2014, challenging the order of dismissal. This Court, by its order, dated 27.07.2021 disposed that __________

WP(MD) No. 29913 of 2025 writ petition by setting aside the order of dismissal and directing the Joint Registrar of Co-operative Societies, Dindigul to conduct an enquiry and pass appropriate orders. Thereafter, the Join Registrar has passed an order on 24.06.2022, that the charges framed as against this petitioner were not proved. It was also directed to treat the period from 08.11.2011 to 27.06.2022 as continuity of service, however, held that no salary would be paid on ‘No work No pay’ principle. Aggrieved over the same, the petitioner has filed this writ petition, seeking a Mandamus, to the respondents to settle him the salary arrears and other consequential benefits for the above mentioned period.

The learned Government Advocate (Civil side) appearing for the respondents submits that the claim of this petitioner has already been decided by the Joint Registrar of Co-operatives, under Section 153 of Tamil Nadu Co-operative Societies Act,1983. If the petitioner is still aggrieved by that order __________

WP(MD) No. 29913 of 2025 with regard to ‘No work, no pay’, he has to challenge the same, before the Government, under Section 154 of the Tamil Nadu Co- operative Societies Act, 1983.
3. In view of the above, this writ petition is closed with liberty to this petitioner to challenge the portion of the order passed by the Joint Register, dated 24.06.2022, denying back wages to the petitioner, before the Government, under Section 154 of the Tamil Nadu Co-operative Societies Act, 1983. In the event, if the petitioner files any review application within a period of four weeks from today, the review authority shall entertain the same without insisting on limitation and decide the same on its merits and in accordance with law.
