PRAYER: S.38 Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent Nos.1 to 3 to withhold the retirement benefits payable to the 6th respondent to an extent of Rs.8,19,973/- and remit the same to the account of the 5th respondent for being paid to the petitioner within the period that may be stipulated by this Honourable Court and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.

The Administrator of O.726 Prakasapuram Co-operative Urban Bank Ltd.Thoothukudi has filed this writ petition, seeking a Mandamus to the respondents 1 to 3, to withhold the retirement benefits of one I.Dulci Freeda, a Head Master of Elliot Tuxford Girls Higher Secondary School, Tuticorin. __________

2. The case of the petitioner is that the sixth respondent has borrowed some amount from the petitioner Bank, however, he failed to repay the same. Therefore, a representation has been made by the petitioner Bank to the Chief Educational Officer and the District Educational Officer, Tuticorin to deduct the loan amount from the retirement benefits of the sixth respondent and also filed this writ petition.
3. Today (03.11.2026), when this writ petition is taken up for hearing, the learned counsel for the petitioner Bank submits that the sixth respondent has settled the loan amount as on date and therefore they are not pressing this writ petition.
