IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

T.P:6/2026

City Union Bank Ltd V/S M/s Green Lays Apparels & 6 ors 04/11/2026

This transfer petition is filed for transferring the OA 114/2011 from DRT, Coimbatore to DRT-III, Chennai.

2. Learned counsel for the petitioner submits that the incumbent Presiding Officer, Mr. N. Somasundaar, DRT, Coimbatore was the counsel on record when the said OA 114/2011 was filed. Thus, he prays for transfer of the OA 114/2011.

3. Notice taken to R2 and R5 had been returned as deceased. Despite service of notice to other respondents, none appeared.

4. In view of the reasons stated, this Tribunal is of the view that when the present incumbent presiding Officer, Mr. N. Somasundaar, DRT, Coimbatore has filed the OA 114/2011 before the DRT, Coimbatore, it is not appropriate for him to decide this case.

5. In this view of the matter, this transfer petition is allowed. Since the DRT, Madurai, is nearer to DRT, Coimbatore, this Tribunal directs that OA 114/2011 is to be transferred to DRT, Madurai for disposal in accordance with law.

6. The learned Presiding Officer, DRT, Coimbatore is directed to send the records to DRT, Madurai within a period one month from the date of receipt of a copy of this order. On receipt of all the records, the learned Presiding Officer, DRT, Madurai, is directed to take up the case immediately, issue notice for the appearance of the parties and on their appearance, dispose the case as expeditiously as possible on merits and in accordance with law.

7. In the result, this TP 6/2026 is allowed accordingly. Parties shall bear their own costs. Pending IAs, if any shall stand closed.
